Description
Senate supported a client in an extension of time and commercial dispute with a specialist basement contractor seeking compensation for what they considered additional work, 18 weeks extended time, and additional preliminary cover.
Challenge
The contractor pressured the client with inflated claims and delay notices lacking reasonable justification. Despite disputing the claims, the client struggled to respond effectively due to the contractor’s aggressive and coercive position. Expert intervention was required to present a structured and substantiated case.
Goal
Senate conducted a comprehensive assessment of the contractor’s claim, analysed all delay notices with supporting evidence, and demonstrated that the project timeline remained contractually defined, preventing the contractor from claiming that time was ‘at large’.
Outcome
Senate successfully represented the client, limiting the contractor’s entitlement to an extension of less than one month. The Adjudicator ruled that the contract had unjustifiably applied for additional time, leading to a fair and favourable resolution for the client. Furthermore, the Senate managed to agree on the final account settlement following the adjudicator's decision with the Contractor, saving the client additional fees.
