Description
Senate undertook to mediate upon an emerging dispute resolution project for an
11,000 sqft private dwelling within the UK. We were appointed as the Employer’s Agent assisting with the complex technical and contractual matters, and we provided contractual and commercial support, including in-depth data analysis, project delay assessments, and procedural guidance to protect our client’s interests. During the initial review, we determined the rationale for the employer to calculate the time due to the Contractor based upon his 2+ year time extension claim, and we provided an assessment of any overclaims supporting the quantity surveyor. Post Contract, we assisted with the project management to completion
Challenge
Senate conducted an extensive review of historical emails and documentation, dating back several years, to build a compelling case. The primary challenge was consolidating this information in a clear and logical manner so the Adjudicator(s) could accurately determine liability.
Goal
Senate were appointed to help unravel the complex claims and arguments for the client and professional team. Senate helped with clarity to simplify the contractual and commercial compliance of the contractor, and through third-party processes.
Outcome
Senate successfully represented the client, securing a significant recovery from the Contractor. This not only alleviated the client's financial burden, but Senate also facilitated the completion of the work to a standard that met building control approval.
